Several years ago, laws were passed to make it easier for foreigners to hold 70-year leases on land. In 2020, foreigners were then made allowed to own apartments through 30-year lease agreements with possible 20 year extensions. One can obtain, but not own, landed houses through a lease contract.

The freehold title (Hak Milik, or Right of Ownership), is only given to an Indonesian national. But with current regulations in place, a foreign- er is able to buy a property in Indonesia via a PT PMA company. After the purchse, one is later able to request a Hak Guna Bangunan (HGB, or Right to Build). With a HGB, your company’s name will be in the land cetificate registered with the Indonesian Land Office. With a small fee, the HGB title can be converted into a Hak Milik title, thus allowing one to hold a proper freehold certificate in one’s company name.
